    Yes. DWI cases get dismissed for illegal traffic stops, improper testing procedures, lack of probable cause, or constitutional violations. We've had cases dismissed due to uncalibrated breathalyzers, protocol failures, and illegal stops. Every case is different, but dismissal is always our goal.

    What is the best plea deal for DUI?

    It depends on your case. Options include reducing DWI to a careless driving plea (no DWI on record), pursuing alternative sentencing to avoid jail, or proceeding to trial. As a former prosecutor, I know which deals are realistic and which to reject. We'll discuss your best options honestly.

    How long will a DWI stay on your record in NM?

    Permanently. New Mexico doesn't allow DWI expungement once convicted — it stays on your record for life and appears on all background checks. This is why aggressively fighting the charge from the get-go matters, as you only get one chance. There are, however, ways that an experienced New Mexico DWI attorney can lessen the impact through obtaining a deferred sentence. If we can get a deferred sentence, it will not be considered a conviction, as long as the probation is completed successfully.

    Can a lawyer get a DWI dropped?
